Equity in private wetland leasehold rental rates

Waterfront Action Group is a subcommittee of BOA that is campaigning for equity in the setting of rental rates for private leaseholds covering wetland (waterfront) areas. These leaseholds include jetties, wharves, pontoons, pools, slips and boat storage areas adjacent to private freehold waterfront property.

BREAKING NEWS!

Four members of the Waterfront Action Group (WAG) have appealed their 2009 rents to the Land and Environment Court (LEC) which agreed to hear one of the appeals on a test case basis. In October 2010 Justice Pain of the LEC dismissed the appeal on the basis that the words "The rate of return will need to be regularly reviewed" within the IPART recommendation did not provide sufficient clarity to give either the Minister or the Court the power to review the rate of return, as the 4 members had requested. WAG has lodged an appeal of this decision with the Court of Appeal and is now seeking donations to fund the cost of that appeal. Further details are available on the WAG website.
